DMCA — Procedures for Notice and Content Removal

1. Overview

SkyHub4K values the intellectual property of others and requires its users to uphold the same standard. Following the Digital Millennium Copyright Act of 1998 ("DMCA"), we will swiftly address reported copyright violations involving our platform when notified by our designated agent.

2. Reporting Copyright Infringement

If you think content accessible via our service infringes on your copyright, you may send a DMCA takedown notice to our assigned agent. Your notice needs to include the following details:

  • Identification of the copyrighted work that you claim has been infringed, or if multiple works are covered, a representative list of such works.
  • Identification of the material that you claim is infringing and that you want removed or access to which you want disabled, with enough detail so that we may locate the material.
  • Your contact information, including your full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Your physical or electronic signature.

3. Designated DMCA Agent

All valid DMCA notices will be responded to within 48 business hours of receipt.

4. Counter-Notification

In case you think the content you shared was taken down or disabled incorrectly or due to misidentification, you have the option to submit a counter-notification to our designated agent. Your counter-notification should contain:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Once we receive a valid counter-notification, we will pass it on to the original complainant. If the complainant does not initiate legal action within 10 business days, we might reinstate the removed content.

5. Repeat Infringers

In compliance with the DMCA, we implement measures to terminate accounts under appropriate conditions for users considered habitual infringers. Our discretion also allows us to limit service access or close accounts of individuals infringing on others' IP rights, irrespective of recurrence.

6. Good Faith Requirement

Be advised that Section 512(f) of the DMCA holds individuals accountable for damages, such as costs and attorney fees, if they knowingly misrepresent material as infringing or falsely claim content was removed in error.

7. Modifications to This Policy

This DMCA Policy may be updated at our discretion. Modified versions will be published here with a new effective date. Your ongoing use of our platform following adjustments signifies your consent to the revised terms.
